1. Petitioner renews the prayer for grant of bail.

2. Prayer for bail was rejected on June 19, 2025 passed in CRM (NDPS) 253 of 2025. Subsequent thereto, police filed charge sheet in September 20, 2025. Charges are yet to be framed since one of the accused was absconding. Commercial quantity of narcotics was seized from the possession of the petitioner. There is hardly any material change in circumstance from the earlier order of rejection.

3. Petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

4. State will take steps for the purpose of splitting up of the trial since one of the accused was absconding.

5. Accordingly, the prayer for bail of the petitioner is rejected.

6. CRM (NDPS) 78 of 2026 is dismissed.
