Affidavit of service filed by the petitioner is kept with record.

The petitioner has retired from service on 30.11.2018 and first PPO was issued on 3.12.2021. In the meantime, ROPA rule was introduced with effect from 1st January, 2019 and subsequently revised PPO was issued on 4.2.2019 and actual pension and gratuity were released on 7.3.2022. Now the petitioner claims for interest on gratuity as well as interest on arrears of pension with effect from 30.11.2018 till 7.3.2022.

Considered the submission of the learned Counsel for the petitioner, this Court finds that there is a delay of more than three years in releasing gratuity and pension of

the petitioner. The petitioner is entitled to get interest on gratuity as well as on arrears of pension with effect from 30.11.2018 till 7th March, 2022 a the rate of 10% per annum.

The respondent nos. 2 & 3 are directed to release interest at the rate of 10% per annum as gratuity and arrears of pension from 30.11.2018 to 7.3.2022 within a period of four weeks from the date of receipt of the copy of the order.

WPA 213/2023 is thus disposed of.
