Present appeal has been filed challenging the judgment and order 23rd December, 2025 passed by the learned Judge, Special (CBI) Court, Siliguri.

The appellant has been convicted for the offence under Sections 7 and 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act. Learned Special Judge has awarded rigorous imprisonment for a one year and a fine of Rs.5,000/- in default to suffer simple imprisonment for one month punishable under Section 7 and rigorous imprisonment for one year and a fine of Rs.5,000/- in default simple imprisonment for one month under Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.

Both the sentences were directed to run concurrently. The appeal has been field in time.

Learned counsel submits that appellant was on bail during the course of trial and was granted bail by the learned trial court.

Taking into account and facts circumstances, the appellant is admitted to bail on furnishing a personal bond of Rs.10,000/- with two sureties of the like amount each, subjection to the satisfaction of the learned Judge, Special (CBI) Court, Siliguri till the disposal of the bail. Subject to the conditions that the appellant shall furnish his permanent address and shall attend the trail regularly. 6.
Appeal is admitted.

Notice be issued to the State of West Bengal though the office of the learned Public Prosecutor.

CRA (SB) 1 of 2026 is allowed.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
