The instant revisional application being CRR 25 of 2021 was filed for seeking alteration or modification of the order no.4 dated 03.7.2020 passed by the learned Sessions Judge, Darjeeling whereby deciding an application for anticipatory bail the learned Sessions Judge, as aforesaid, directed the Investigating Officer to investigate the case in order to "unearth the actual manner of incident and in the meantime the ADSR, Bagdogra as well as ADSR, Siliguri are directed not to go for registration on the strength of registered power of attorney for any conveyance deed of any nature whatsoever". Learned advocate for the State/petitioner was requested to enquire of the status of the registration of the deed being conducted as on date and it was submitted by Mr. Nilay

Chakraborty, learned counsel for the State/petitioner that despite the order the registration of deeds are effectuated in accordance to law following the general principles. Under the facts and circumstances of the case, the order no.4 dated 03.7.2020 passed by the learned Sessions Judge, Darjeeling in Criminal Misc. Case No.80 of 2020 is modified to the extent that the statement being "Investigating Officer to investigate the case in order to unearth the actual manner of incident and in the meantime the ADSR, Bagdogra as well as ADSR, Siliguri were directed not to go for registration on the strength of registered power of attorney for any conveyance deed of any nature whatsoever" be deleted and not given effect to.
