(A) 83 of 2026 In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tufanganj Police Station Case No. 740 of 2025 dated 21.12.2025 under Sections 126(2)/115(2)/117(2)/109/3(5) of the BNS.

The petitioners are the brother in law and sister in law of the victim lady and submit that they have been falsely implicated due to a land dispute between the parties. Learned counsel for the State opposes the prayer. I have considered the material on record including the statement of the victim as well as her injury report. Investigation is in progress. Material available in the case diary does not justify custodial interrogation of the petitioners.

Accordingly, in the event of arrest, the petitioners be released on bail on furnishing bond of Rs.10,000/-(Rupees

Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to conditions laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and subject to further condition that the 1st petitioner shall meet the investigating officer once a week till submission of charge sheet. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. The application being CRM (A) 83 of 2026 is disposed of.
