The husband of the petitioner was retired from service on 31st July, 2016 and the PPO was issued on 26th July, 2016. In the meantime ROPA Rule was introduced with effect from 1st January, 2019 and subsequently on 31st December, 2021 the PPO of the husband of the petitioner was revised.

On 2nd January, 2022, the respondents have disbursed the gratuity and the arrear of pension to the petitioner. In the meantime, on 18.4.2020 the husband of the petitioner died. Now the wife of the employee claims interest on gratuity and arrears of pension on and from 31st July, 2016 till 2nd January, 2022.

Considered the submission made by the Counsel for the petitioner, this Court finds that the petitioner is entitled to get interest on gratuity as well as arrear of pension with effect from 31st July, 2016 till 2nd January, 2022. The respondent nos. 2 and 3 are directed to release the interest on gratuity as well as on the arrears of pension within a period of four weeks from the date of communication of this order.

WPA 242/2023 is thus disposed of.
