1. Petitioner is in custody for three months. He contends he is not involved in the murder. Charge sheet has been filed under section 238/61(2) of BNS 2023 which is a bailable offence. He prays for bail.

2. Learned lawyer for the State submits petitioner is involved in a sex racket wherein an army personnel was murdered.

3. We have considered the materials on record. The victim had been lured through sexual advances by a lady to come to her residence. Thereafter, he was murdered by two persons along with the lady. Subsequently, petitioner's assistance was taken to dispose the dead body. In this background charge sheet has been filed against the petitioner under section 238/61(2) of BNS 2023 which is a bailable offence.

Keeping in mind the extent of complicity of the petitioner in the crime we are inclined to grant bail to him.

Accordingly, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned CJM Jalpaiguri on condition that the petitioner shall appear before the trial court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

5. In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court.

6. The application being CRM (DB) 38 of 2025 is disposed of.
