(A) 86 of 2026 In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pundibari Police Station Case No. 407 of 2025 dated 04.05.2025 under Sections 20(b) (ii)(c)/25/29 of the NDPS Act.

Learned counsel for the petitioner submits that no recovery has been made from the petitioner. He has been named by the co accused. Charge sheet has been submitted. Opposing the prayer, learned counsel for the State submits that the petitioner and others were travelling in the vehicle from which the narcotic substances were recovered. Though the petitioner managed to flee from the spot, he was identified and named by the co accused who was apprehended alongwith the seized contraband.

In view of the statutory restrictions laid down under Section 37 of the NDPS Act, prayer for anticipatory bail is rejected.

The application being CRM (A) 86 of 2026 is disposed of.
