The petitioner is already in custody for more than 225 days in connection with Jaigaon P.S. Case No. 187 of 2018 dated 14.09.2018 for committing offence punishable under Sections 409/201/213/120B/34 of the Indian Penal Code read with Sections 7/8/12/13(1) of the Prevention of Corruption Act, 1988.

According to the petitioner, he is a driver by profession and has no nexus with the alleged offence. Neither he was seen at the spot nor was apprehended therefrom, when the team intercepted a car driven by some other persons wherefrom the gold bars were recovered. Lastly, it is submitted that he has been falsely implicated and, therefore should be released on bail.

We have perused the case diary produced by the State and after considering the materials available therefrom as well as the seriousness of the offence, we do not feel that it is a fit case where the petitioner should be enlarged on bail. The prayer for bail of the petitioner is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
