...... petitioners Mr. S Chatterjee Ms. S. Biswas ...... for the petitioners Mr. S Bapuli ...... for the State It is submitted on behalf of the petitioners that they are not the principal accused and they have been falsely implicated in the instant case.

Learned lawyer for the State opposes the prayer for anticipatory bail and submits that the petitioners are the relations of the principal accused who had a love affair with a minor girl. Subsequently he refused to marry the victim and committed suicide.

Having considered materials on record and bearing in mind the extent of complicity of the petitioners who are the relations of the principal accused in the alleged crime, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.

Petitioners shall appear before the investigating officer and hand over their passports, if any, within a fortnight from date. In

the event they do not have a passport, they shall personally appear before the investigating officer and furnish affidavit to that effect within the time frame mentioned hereinabove.
