Bappi Barman v. The State Of West Bengal
AD 21 IN THE HIGH COURT AT CALCUTTA March 17, 2026 Circuit Bench at Jalpaiguri Ct. 6 Criminal Miscellaneous Jurisdiction SG CRM(A) 90 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sahebganj P.S. Case No.349 of 2025 dated 17.06.2025 under Sections 21(c)/20(b)(ii)(B) of the NDPS Act.
And In the matter of: Bappi Barman ... petitioner Mr. Sudip Guha Ms. Ankita Nag ... for the petitioner Mr. Kallol Acharjee Mr. Tapan Bhattacharjee Mr. Dhiman Sil ... for the State Learned counsel for the petitioner submits that other than the statement of a co-accused, there is no other material available against the petitioner, Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of locals to show that the contraband was recovered from the petitioner's house. Considering the above, the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Jay Sengupta, J.)
