CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI 04.02.2021 p.b./rrc C.R.M. 187 of 2021 (Via Video Conference) In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Siliguri Police Station Case No. 1147 of 2020 dated 29.08.2020 under Sections 420/465/ 467/468/471/120B of the Indian Penal Code.

In the matter of : Rajen Koley ... petitioner Mr. Sukanta Chakraborty Ms. Esha Acharya Mr. Sayan De .....For the petitioner Mr. Kallol Acharjee Mr. Biswarup Roy ......For the State The petitioner undertakes to affirm and stamp the application as per the rules within 48 hours. The application is taken up on the basis of such undertaking.

In view of the fact that a co-accused has already been enlarged on bail and taking note of the submission of learned counsel appearing for the petitioner that the petitioner is available for questioning and is presently residing in the address shown in the cause-title, we are of the view that the application for anticipatory bail may be allowed.

In the event of arrest, the petitioner will be released on bail upon furnishing a bond of Rs.20,000/- with two sureties each of like amount to the satisfaction of the arresting officer. The petitioner will be subjected to the conditions of Section 438(2) of

the Code of Criminal Procedure and shall make himself available for questioning/investigation before the concerned police officer every week or as required by the concerned police officer and intimate the petitioner.

In addition, the petitioner shall, however, not leave the jurisdiction of Siliguri Police Station and will cooperate with the investigating authority. The petitioner will appear before the investigating authority every week or in accordance with the necessity of the case as and when required.

CRM 187 of 2021 is allowed and disposed of in terms of the above.
