Adv. Nilay Chakraborty, Adv. Subhasish Misra, ... for the State Learned counsel for the petitioner submits that the name of the petitioner has transpired from the statement of the co accused. No recovery has been made from the possession of the petitioner. Learned counsel for the State opposes the prayer. It appears that the name of the petitioner has transpired from the statement of the co accused. No narcotic substance has been recovered from the possession of the petitioner. In view of the above, this Court is inclined to hold that the petitioner has been able to rebut the statutory restriction under Section 37 of the NDPS Act.

Accordingly, this Court directs that in the event of arrest, the petitioner namely Paban Kumar Sinha @ Pawan Kumar Sinha be released on bail on furnishing bond of Rs.20,000/-(Rupees twenty Thousand only) with two sureties of like amount each, to the satisfaction of the arresting officer subject to conditions laid down

under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall surrender before the jurisdictional Court and pray for regular bail within two weeks from date. CRM (A) 94 of 2026 is, thus, disposed of.
