Terai Tea Company Limited And ANR. v. The State Of West Bengal And ORS.
Court No. 2 Calcutta High Court In the Circuit Bench at Jalpaiguri Appellate Side WPA 344 of 2025 Terai Tea Company Limited & Anr.
Vs.
The State of West Bengal & Ors.
(1490) 07.04.2025 (JPD 23) (S. Banerjee) Mr. Bikramaditya Ghosh ... for the petitioners Mr. Joyjit Choudhury, Ld. AAG Mr. Subit Kumar Saha Mr. Nabankur Paul ... for the State Learned Additional Advocate General raises an objection as to the maintainability of this writ petition in view of existence of an alternative remedy.
The petitioners have challenged the wrong recording as to the status of the petitioners in the record of rights and have prayed for correction of such record of rights.
In view of the alternative, efficacious remedy available under the West Bengal Land Reforms and Tenancy Tribunal Act, 1997, this Court is not inclined to entertain this writ petition.
At this stage Mr. Ghosh, learned advocate appearing for the petitioner submits that a liberty be given to the petitioner to make a representation before the Land Reforms Commissioner. He further submits that a representation to that effect has already been submitted by the petitioner before the District Land and Land Reforms Officer and a direction be passed upon such authority to transmit the same to the Land Reforms Commissioner.
It will be well open to the petitioner to approach the District Land and Land Reforms Officer for transmitting the said representation before the Land Reforms Commissioner.
With the above observations, the writ petition stands disposed of.
