The present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred in connection with Maynaguri Police Station Case No.237 of 2023 dated 20.06.2023 under Sections 498A/307/326/302 of the Indian Penal Code, 1860.

Mr. Kumar Santanu, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. Upon completion of investigation chargesheet has already been submitted. He has already suffered incarceration for more than two years. Out of 19 witnesses only 4 has been examined and as such, there is no possibility towards conclusion of the trial in the near future.

Mr. Acharjee, learned advocate appearing for the State opposes the petitioner's prayer drawing our attention to the several documents in the case diary including the post-mortem report.

Considering the gravity of the offence, its ramifications and the extent of complicity of the petitioner in the alleged offence, we are not inclined to exercise discretion in favour of the petitioner at this stage.

The application for bail, being CRM (DB) 41 of 2025 is, accordingly, dismissed.
