Learned counsel for the petitioner submits that no recovery has been effected from the present petitioner and he has been rope in only on the basis of the disclosure statement. Co-accused Alimuddin Sekh, Abujar Hossain were admitted to bail by the Co-ordinate Bench of this Court vide order dated 10th September, 2025 in C.R.M. (NDPS) 403 of 2025. Learned counsel for the State has opposed the prayer for bail application. Learned counsel for the State has fairly submitted that no recovery was effected from the possession of the present petitioner.

Since no recovery was effected from the present petitioner and he has been arrested only on the disclosure statement of co-accused, thus taking into the facts and

circumstances of the case, the petitioner, viz. Bablu Hoque is admitted to bail upon furnishing a personal bond of Rs. 10,000/- with two sureties of like amount, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 1st Court (NDPS) Cooch Behar, subject to the condition that he shall attend the trial regularly and subject to the conditions as laid down under Section 439 of the Cr.P.C. corresponding to Section 483 of the BNSS, 2023 and on further condition not to threaten or intimidate witnesses and to attend the jurisdictional court on dates fixed.

The application for bail is allowed.

C.R.M. (NDPS) 108 of 2026 stands disposed of. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
