In the writ petition petitioner has made a grievance that she on being enlarged on bail vide order dated 12th December, 2023 in spite of attempts being made could not enter into her premises and there was threat and coercion by some persons. It is also alleged in a letter addressed to the Commissionerate, Siliguri Metropolitan Police that necessary steps are required to be taken by the concerned police authorities in order to facilitate the petitioner to get the relief.

Learned advocate representing the State respondents submits that though a complaint has been made to the Commissionerate, Siliguri Metropolitan Police but the concerned police authority is Bhorer Alo Police Station and it has further been contended on behalf of the State respondents that no formal complaint has been

lodged before the said police station. According to the State respondents petitioner can also take steps in accordance with law by initiating appropriate proceeding under the Code of Criminal Procedure.

Having considered the grievance made in this writ petition and submission made on behalf of the parties the writ petition stands disposed of by granting leave to the petitioner to lodge a complaint before the Inspector-in-Charge Bhorer Alo police station describing petitioner's plight. If the complaint is made it is expected that the concerned police authorities shall take steps in accordance with law in order to dispose of the grievance of the petitioner.

However, this order shall not preclude the petitioner to take steps in terms of the relevant provisions of the Code of Criminal Procedure for getting relief.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
