1. Petitioner prays for bail on the ground of parity with the coaccused who was granted bail by the Coordinate Bench on December 18, 2025 passed in C.R.M. (M) 334 of 2025.
2. Petitioner is in custody in excess of 708 days. Charge sheet was submitted on March 11, 2024. Charges are yet to be framed.
3. Coordinate Bench noted that the other co-accused was incarcerated for about 709 days and that despite the direction of Court, trial did not start.
4. In such circumstances on the ground of parity, petitioner is granted bail.
5. Accordingly, petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge
Special Court, (under POCSO Act), Additional Sessions Judge, Mal, Jalpaiguri subject to condition that the petitioner will, however, not enter into the jurisdiction of the local police station excepting for the purpose of reporting to the police station and for the purpose of appearing before the Court. The petitioner shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.
6. In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court.
7. The prayer for bail of the petitioner is allowed.
8. CRM(M)/43/2026 is disposed of.
