The petitioner is aggrieved by non-issuance of the Admit Card entitling the petitioner to sit for the supplementary examination in the failed subject in the 3rd semester examination, which was held in 2018. It is the contention of the petitioner that the petitioner took first semester examination of B.Ed. course under the concerned university in the year 2017.

The petitioner got supplementary in the subject 1.1.1. As per procedure the petitioner appeared in the supplementary-I examination along with 2nd semester examination in 2018 but did not clear the supplementary paper. The petitioner sat for 3rd semester examination which was held in December, 2018 but did not sit for the supplementary examination in the subject which the petitioner could not clear in the first semester held in December, 2017. According to the petitioner, no admit card was issued to the petitioner enabling him to sit for the supplementary examination in the subject the petitioner could not clear the 1st semester examination.

After passage of time, the petitioner made a representation to the College authorities to enable the petitioner to clear the supplementary paper of 1st semester examination of 2017 along with the 4th semester examination. The College authorities requested the University to consider the matter and such consideration has not been done. The 4th semester examination is to commence on June 17, 2019.

Mr. Amitava Chowdhury, learned Advocate appearing for the University submits that the rules did not permit, the petitioner to take the supplementary examination of the 1st semester which was held in 2017 along with 4th semester examination. It is his submission that according to the rules, this examination should have been taken as a last chance with the 3rd semester examination which was held in December 2018.

Under such circumstances, no order can be passed in this writ application. However, the respondent University ought to have intimated its decision to the college but had not done so. The petitioner is given liberty to approach the Controller of Examinations of the concerned University within June 7, 2019 ventilating her grievance and the University will consider the matter in accordance with law.

A reasoned order should be passed and communicated to the petitioner within June 14, 2019.

There will be no order as to costs.

The respondents will act on the basis of the learned Advocate's letter without insisting on the certified copy. (Shampa Sarkar,J.)
