Learned advocates representing the petitioner, the Board of Secondary Education and the School submit that the admit card of the candidate has been handed over.
Learned advocate for the School has expressed unconditional apology for the harassment that has been caused to the candidate. Undertaking has been given that such type of incident will not recur in future. In view of the fact that the candidate has been issued the admit card and she will be able to appear in the madhyamik examination scheduled to start tomorrow, the Court is not passing any further direction in the matter.
Prayer has been made by the Board for imposing costs upon the School as has been done by a coordinate Bench of this Court in similar matters.
Considering the apology made by the School authority, prayer for costs is disallowed.
The appearance of the learned advocate appearing for the West Bengal Board of Secondary Education has been inadvertently recorded in the order dated 30.01.2024 as appearing for the State.
Let the same be rectified. Let it be recorded that Mr. Anirban Banerjee is appearing on behalf of the West Bengal Board of Secondary Education in this matter.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
