The grievance of the petitioner is failure on the part of the concerned police authorities to take appropriate steps based on an FIR in connection with an alleged offence under Sections 407, 420, 379, 34 of the Indian Penal Code.

Petitioner prays for appropriate direction upon the concerned police authorities for completion of investigation.

The learned advocate representing the Staterespondents has submitted a report signed by the Officer-in-Charge, Sitalkuchi, Coochbehar dated 5th February, 2024 wherefrom it appears that pursuant to the direction of the learned Additional Chief Judicial Magistrate, Mathabhanga, Coochbehar a case was started being Sitalkuchi P.S. Case No.

12/22 dated 16th January, 2022. In the said report in details steps which have been taken by the police authorities have been disclosed.

Having considered the nature of offence complained of and the steps taken by the police authorities this Court finds that there is no reason to interfere with the process of investigation by giving directions in exercise of the writ jurisdiction of this Court.

However, the learned advocate representing the State-respondents is directed to supply the report dated 5th February, 2024 to the learned advocate for the petitioner in course of this day Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
