Learned advocate appearing for the petitioners challenged the proceedings arising out of Bhaktinagar P.S. Case No. 923/2023 dated 16.10.2023. Learned advocate for the petitioners submits that the present petitioners happen to be the mother-in-law and sister-in-law of the de facto complainant/opposite party no.2.
Mr. Biswas, learned advocate appearing for the State submits that during the pendency of the revisional application, already charge-sheet has been submitted before the jurisdictional court on or about 28.07.2024. It has also been submitted on behalf of the State that charge-sheet has been submitted under Sections 498A/323/506 read with Section 34 of the Indian Penal Code.
Having considered the fact that the petitioners approached this Court for quashing of the FIR and subsequently charge-sheet has been submitted, I am of the view that there has been change of circumstances.
Consequently the petitioners would be at liberty to approach this Court after receipt of the documents under Section 207 of the Code of Criminal Procedure or after praying for discharge at the stage of consideration of charges before the learned Trial Court.
With the aforesaid observations, the revisional application being CRR 49 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
