Learned counsel appearing on behalf of the petitioner submits as follows. In 1984 the petitioner was appointed as a household survey worker under the I.R.D.P. by the Executive Officer, Kurseong Block Panchayat Samity. In 1985, the Pradhan Gayabari II gram panchayet appointed the petitioner as collector. In 1990 the petitioner was deputed as an officer to correct the electoral roll by the SubDivisional Magistrate, Darjeeling. In 1991 petitioner was appointed as an enumerator. In this fashion on several dates thereafter the petitioner was engaged to perform official duties by such authorities. Lastly, on 22.04.2015 the Assistant Electoral Registration Officer, Kurseong engaged the petitioner as a booth level officer. In spite of all these, the petitioner was never given a proper appointment letter.
Consequently, he was not paid regular salary. On 08.01.2022 the petitioner made a comprehensive representation before the authority concerned, but the same was not considered.
Learned counsel appearing on behalf of the respondents submits as follows. The respondents dispute the petitioner's claim to wages or pension. However, if the petitioner wishes to have his representation considered by the respondent no. 5, the same can be done within a stipulated time.
I have heard the submissions of the learned counsels for the petitioner and the respondents and have perused the revision petition.
The allegations are not admitted since affidavits are not called for.
In view of the above, the respondent no. 5 is directed to consider the representation of the petitioner dated 08.01.022 within four weeks from the date of communication of this order and pass a reasoned order within a fortnight therefrom after giving an opportunity of hearing to the petitioner.
With these observations, the writ petition is disposed of.
