Acharjee Heard on : 19/03/2026 Judgment on : 19/03/2026 Jay Sengupta, J.:- This is an application praying for expeditious disposal of a proceeding being Complaint Case No. 468 of 2024 under Sections 138 and 142 of the N.I. Act pending before the learned Judicial Magistrate, 2nd Court at Jalpaiguri.

Affidavit of service filed on behalf of the petitioner is taken on record.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the complainant in this case. He had filed the petition of complaint in 2024. Yet, till date even the plea could not taken. The trial has made pending for no fault of the petitioner. Heard the learned counsel appearing for the State. Despite service, no one appears on behalf of the accused/opposite party.

It appears that the proceeding has remained pending since 2014. At least on a few occasions no one appeared and warrant had to be issued against the accused.

Considering the above and in the interest of justice, the learned Court is directed to expedite the proceeding and conclude the same in accordance with law without granting unnecessary adjournments to any of the parties and to ensure the presence of the parties, if necessary by taking appropriate coercive measures and by keeping in mind that statutory stipulations regarding expeditious disposal of a proceeding under the said Act. With the aforesaid observations and directions, the revisional application is disposed of.
