Present petition has been filed seeking recall of the order of warrant of arrest dated 1st April, 2014 issued by the learned Additional Chief Judicial Magistrate, Tufanganj. 2.

The petitioners have also advanced/had challenged all the subsequent orders passed in G.R. No. 334 of 2012. The petition on the face of it is clear abuse of the process of the court. The petitioners instead of approaching the court which has issued the warrant has invoked jurisdiction of this court without any cogent reason.

Apparently, the petitioners have been absconding for the last 12 years such kind of frivolous conditions are liable to be rejected out rightly with costs and the present petition is dismissed with a cost of Rs.1,000/- to be deposited with District Legal Aid Committee. The cost of receipt be filed within 30 days. 4.

Let the compliance be placed before the next Circuit Bench.
