Mr. Sagar Bandopadhyay Mr. Soumyajyoti Nandy ...For the Petitioner Mr. Subir Kumar Saha Mr. Bikramaditya Ghosh ...For State Respondents Mr. Sagar Bandopadhyay, learned Counsel akb appearing on behalf of the petitioner submits that certain events have taken place subsequent to filing of the writ petition. He accordingly submits that he be allowed to withdraw the writ petition with liberty to approach the District Magistrate & Collector, by filing a representation that may be disposed of within a time bound manner. In the light of the above submissions made on behalf of the petitioner, I direct the petitioner to file his representation within a period of 10 (ten) days from date, and upon receipt of such representation, I direct the District Magistrate & Collector, Darjeeling, being the respondent No. 2, to dispose of the said representation upon granting an opportunity of hearing to the petitioner and thereafter pass a reasoned order within a period of four weeks from date.

The reasoned order should be communicated to the petitioner within a week from the date of passing such reasoned order.

With the aforesaid observation the writ petition is disposed of.

Since, no affidavit-in-opposition has been called

for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.
