The sole grievance of the petitioner is that notwithstanding an order passed by the Hon'ble Supreme Court in Civil Appeal No.3754 of 2017 the State respondents have not taken any action whatsoever. The petitioner contends that he has filed a representation dated 25th July, 2017 and the concerned respondents has deliberately kept the same in abeyance and taken no steps whatsoever. Counsel on behalf of the State submits that, he has no objection if the respondent no.2 being the Principal Secretary, Transport Department, Govt. of West Bengal is directed to consider the representation of the petitioner dated 25th July, 2017 (Annexure P-5, at page 37 to the writ petition).

In view of the submission made on behalf of the parties, I direct that the respondent no.2 shall consider the aforesaid representation of the petitioner dated 25th July, 2017 and pass a reasoned order in accordance with law within a period of eight weeks

from the date of communication of this order and shall communicate the same to the petitioner within two weeks thereafter.

It is needless to mention that, I have not gone into the merits of the disputes between the parties and the respondent no.2 will consider the representation of the petitioner without being influenced by any observation made in this order and give a right of hearing to the petitioner, if necessary. With the aforesaid directions WPA 168 of 2019 is disposed off.

There will be no order as to costs.
