CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI 11.02.2021 p.b./rrc C.R.M. 225 of 2021 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dinhata Police Station Case No. 197 of 2020 dated 15.06.2020 under Section 20(b)(II)(C) of the N.D.P.S. Act, 1985.

In the matter of : Karuna Barman ... petitioner Mr. Arjun Chowdhury .....For the petitioner Mr. Aditi Shankar Chakraborty ......For the State Although there is a difference of view between the parties on whether the petitioner would be liable under the NDPS Act on the quantity of narcotic substances recovered from the petitioner, we are of the view that the marginal difference, if any, in the quantum recovered from the petitioner should be examined at trial.

We, accordingly, direct the learned Special Court to expedite the trial and make an effort to conclude the same within 20 weeks from the date of this order and not later than 17th July, 2021, since the petitioner has already been in custody for 240 days.
