Ratheswari Sarkar -VersusUttar Banga Krishi Viswavidyalaya & Ors. akb Mr. Rajdeep Biswas Mr. Ajay Kumar Singhania ...For the Petitioner This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in granting the family pension in favour of the petitioner, who is the wife of deceased.

It is to be noted that the retiral benefits had been enjoyed by the deceased husband of the petitioner till April 29, 2014. Subsequently, however after his death no family pension has been given to the wife of the deceased.

In spite of service, none appears on behalf of the respondent authorities, and accordingly, I draw an adverse inference against the respondents.

In the light of the above, the respondent authorities, specifically respondent No. 2 herein is directed to consider the representations made by the petitioner, granting an opportunity of hearing to the petitioner and thereafter pass necessary reasoned order within a period of four weeks from the date of communication of this order.

The reasoned order should be communicated to petitioner within a week from the date of passing such

reasoned order.

With the aforesaid observation, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents. There will be no order as to costs.
