(M) 57 OF 2026 In Re : An application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 in connection with Siliguri (T) GRPS Case No. 01/2026 dated 09.01.2026 under Section 85/108/3(5) of BNS, 2023.

And In the matter of : Biswajit Chakraborty & Anr. .... Petitioners Mr. Joydeep Kanta Bhowmik, Mr. Sayantan Bhowmik, Ms. Nipa Das, Ms. Jasmin Haque .... For the petitioners Mr. Bhaskar Das, Mr. Kallol Nag, Mr. Chattu Roy ... for the State Learned counsel for the petitioners submits that victim was married to Pritam Chakraborty in the year 2012. Learned counsel submits that Ms. Rinky Chakraborty is the sister of Pritam Chakraborty and Mr. Biswajit Chakraborty is the husband of Rinky Chakraborty. Mr. Biswajit Chakraborty and Ms. Rinky Chakraborty got married in 2014 and since then they have been residing separately. It has further been submitted that the victim allegedly committed suicide on 26th September, 2025, whereas the FIR was lodged on 9th January, 2026.

It has been submitted that petitioners are in custody for last 46 days.

Learned counsel for the State has opposed the bail application and submits that though there are allegations of demand of dowry and torture but there are no specific allegations against the present petitioners.

The court has considered the submissions. Petitioners are in custody since last around 46 days. They have not been residing matrimonial home since 2014.

Thus, taking into the facts and circumstances of this case the petitioners are admitted to bail by furnishing a bond of Rs. 15,000/- (Rupees fifteen thousand only) each with two sureties of like amount each, one of whom shall be local, to the satisfaction of learned Additional Chief Judicial Magistrate, Siliguri subject to the conditions that they shall attend the trial regularly and shall not threaten, tamper or intimidate the complainant or members of the family in any manner and shall not visit the locality where the defacto complainant and the family are residing.

This application being CRM (M) 57 of 2026 stands disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
