Pursuant to the direction given on 08.8.2023 the de facto complainant is present before the Court with the Investigating Officer.

It is submitted by Mr. Chakraborty, learned counsel representing the State that the parties have settled their dispute out of Court and the de facto complainant does not have any objection if the proceeding in G.R. Case No. 403 dated 18.12.2018 arising out of Kalimpong P.S. Case No. 349 of 2018 is quashed. Having perused the case diary, I find that the case was registered on the allegation that minor girl was sent to middle-east county by the accused persons. The case was registered in 2018. However, in my view the allegation as made out does not merit any order of quashment at this stage.

The criminal revision is dismissed along with application if any.

There shall be no order as to costs.

The personal appearance of Investigating Officer S.I. DFO Narayan Ghising is dispensed with.

The Investigating Officer is directed to inform the Child Welfare Committee Kalimpong while proceeding with investigation. Child Welfare Committee should be taken into confidence. Let a copy of the order be sent to the learned Trial Court for information and necessary action.
