The grievance of the petitioner is that he is not getting his terminal dues as his service book has not been forwarded by the school to the District Inspector of Schools (S.E.), Jalpaiguri. The petitioner retired from service on August 31, 2021. The District Inspector of Schools (S.E.), Jalpaiguri communicated to the President/ Administrator of the Managing Committee of the

school to submit the original service book of the petitioner.

The petitioner alleges that the same has not been forwarded to the District Inspector of Schools (S.E.), Jalpaiguri till date.

Representation filed by the petitioner before the school authority remains unanswered.

The prayer of the petitioner for grant of provisional pension has also not been considered. It appears that the petitioner has retired long back after rendering nearly thirty-seven years and eight months' service. The authorities ought not to delay in grant of his terminal benefits.

As it appears that the school is not taking any steps to forward the service book along with other necessary documents to the District Inspector of Schools, accordingly the District Inspector of Schools (S.E.), Jalpaiguri is directed to take up the issue with the school authority and ensure that all the documents relating to grant of terminal benefits of the petitioner is collected from the school.

The District Inspector of Schools (S.E.), Jalpaiguri shall take steps to make the pension file of the petitioner ready at the earliest and forward the same to the pension granting

authority immediately after the pension file is made ready.

Till such time the pension file of the petitioner is finalized, necessary steps shall be taken by the District Inspector of Schools (S.E.), Jalpaiguri to see that the petitioner receives his provisional pension. Steps for releasing the provisional pension shall positively be taken and the provisional pension be released within a period of twelve weeks hereof.

The Pension Payment Order be positively issued in favour of the petitioner latest within six months from the date of communication of a copy of this order.

The petitioner is directed to communicate this order to the District Inspector of Schools (S.E.), Jalpaiguri along with the supporting documents to the said respondent.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
