Mr. Deborshi Dhar ..for DPSC Appearance of Mr. Banerjee, learned advocate be recorded in the order dated July 29, 2024 as the learned advocate appearing for respondent no.2. Since the petitioner has sought for inter-district transfer as a primary teacher from Cooch Behar to Malda, in my view, the prayer of the petitioner for transfer could not have been considered by the District Primary School Council, Cooch Behar.

Therefore, the rejection order dated April 6, 2023, is set aside. The District Primary School Council, Cooch Behar shall forward the relevant documents including the prayer of the petitioner for transfer before the Secretary, West Bengal Board of Primary Education, respondent no.2 within a period of one month from the date of communication of this order. The Secretary,

West Bengal Board of Primary Education, respondent no.2 shall consider the prayer of the petitioner in accordance with law within a period of three months thereafter.

Accordingly, WPA 300 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
