Petitioner is desirous to be appointed as Muslim Marriage Registrar (MMR) under Jaigaon Police Station, District- Alipurduar and in support of the same based on recruitment notification issued by the concerned respondent authorities an application has been made by the petitioner on 12th November, 2018 which is at page 22 of the writ petition. Learned advocate representing the petitioner has also drawn attention of this Court to the memo dated 3rd January, 2023 issued by the Deputy Inspector General of Registration (Inspection), Presidency Division, Government of West Bengal addressed to the District Registrar, Alipurduar whereby a letter of the Law Department dated 18th October, 2022 along with prayer of the petitioner

were forwarded to the District Registrar, Alipurduar for taking necessary action.

Petitioner prays for taking decision from the end of the District Registrar, Alipurduar being the concerned authority.

State-respondents are represented by learned advocate who also submits that so far engagement of MMR in the District of Alipurduar is concerned, District Registrar, Alipurduar is the appropriate authority.

Having considered the submissions made on behalf of the parties and taking note of the memo dated 3rd January, 2023 issued by the Deputy Inspector General of Registration (Inspection) Court directs the District Registrar, Alipurduar being the respondent no. 5 herein to take decision on the prayer of the petitioner which has been forwarded by the Deputy Inspector General of Registration (Inspection) vide memo dated 3rd January, 2023 within a period of 6 (six) weeks from the date of communication of the order after granting opportunity of hearing to the petitioner or her representative by passing a reasoned order.

The decision to be taken by the respondent no. 5 shall be communicated to the petitioner within a period of 1 (one) week thereafter.

Learned advocate for the petitioner is granted leave to amend the cause title by incorporating the appropriate authority in respect of respondent no. 5. The writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
