1. Affidavit of service filed by the petitioner be kept with the record.

2. The writ application has been preferred praying for quashing of an order dated11.9.2025, wherein the District Inspector of Schools has informed the petitioner under the RTI Act, that the matter regarding his pension is pending before the Headmaster for regularization of the service book for rectification of the basic pay as per rules.

3. The petitioner has further prayed for release of the pension in his favour along with arrear pension with interest at the rate of 18 % per annum.

4. In course of hearing, learned counsel for the respondents submits that the matter is pending before the Headmaster of Mohitnagar Colony , T.P. High School (XII), Post office Mohitnagar , District- Jalpaiguri since September, 2025, though the petitioner has argued that the authorities

cannot regularize his service book after his retirement. It appears that the final decision has not been taken by the said authority. As such, this Court at this stage cannot accept the submission of the petitioner.

5. Accordingly, the writ application is disposed of with the direction that the D.I. of Schools (S.E.), Jalpaiguri shall take immediate steps to ensure that the Headmaster of the Mohitnagar Colony , T.P.

High School (XII), Post office Mohitnagar , District- Jalpaiguri acts as per the order dated 11.9.2025.

6. It is further directed that the Headmaster shall decide the same in accordance with rules and also as per relevant provisions of law, applicable to such an employee and the said matter be decided by the said authority within 30 days from the date of this order, on giving a hearing to the petitioner and the other stake holders, if any, and to pass a reasoned order in accordance with law.

7. WPA 272 of the 2026 stands disposed of.

1. Urgent Photostat certified copy of this order, if applied for, be given to the learned counsel for the parties on usual undertakings.
