1. Affidavit-of-service filed in Court be taken on record. None appears for the de facto complainant.

2. Petitioner is in custody for 50 days.

3. Co-accuseds were granted anticipatory bail.

4. Police filed charge sheet.

5. Prayer for anticipatory bail was rejected by the High Court primarily relying upon the statement recorded under Section 164 of the Criminal Procedure Code.

6. Considering the fact that police completed investigations and filed charge sheet and, considering the gravity of the offence and considering the fact that other co-accuseds are

already on anticipatory bail, it would be appropriate to grant bail to the petitioner.

7. Accordingly, petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge Special Court, (under POCSO Act), 2nd Court, Jalpaiguri subject to condition that the petitioner shall appear before the learned trial court on every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

8. Petitioner will not enter the jurisdiction of the police station except for the purpose of attending the jurisdictional Court and the police station at which police case stand registered. Petitioner will inform the Investigating Officer as also the jurisdictional Court, as to his place of stay until further orders. Petitioner will report the Investigating Officer once in a fortnight until further orders.

9. In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court.

10. The prayer for bail of the petitioner is allowed.

11. CRM(M)/60/2026 is disposed of.
