The petitioner submits that in response to a tender being floated by the office of the Panchayat Samity/Block Development Officer, MadarihatBirpara, District-Jalpaiguri a Work Order was issued to the petitioner for construction of boulder sausage from Anita Chhetri house to Tek Bahadur Tamang house at Pratima Line under Lankapara GP within Madarihat Birpara Block under District-Alipurduar. The petitioner submits that he completed the aforesaid work in terms of the Work Order and submitted his bills in September, 2017 followed up by several representations.
The petitioner complains that neither his representation been considered by the authority nor his bills have been cleared till date. It is further submitted that no reason has been forwarded to the petitioner for not clearing the bills as submitted by
him.
As it appears that the petitioner has already raised his grievance before the Block Development Officer, Madarihat-Birpara, District-Jalpaiguri, no useful purpose will be served by keeping this writ petition pending.
The same is accordingly disposed of by directing the respondent no.6 being the Block Development Officer, Madarihat- Birpara, District-Jalpaiguri to consider the representation made by the writ petitioner for clearing his bills on account of the aforesaid work strictly, in accordance with the relevant rules/guidelines/circulars within 12 weeks from the date of communication of a copy of this order after giving an opportunity of hearing to the petitioner and to pass a reasoned order and communicate the same to the petitioner within a fortnight thereafter. It is made clear that this Court has not gone into the claim of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner. WPA No.203 of 2019 is disposed of.
