This is an application praying for quashing of a proceeding in PTNBOWBJ02P005093/2025 arising out of Bhaktinagar Police Station Case No.812/2025 dated 17.08.2025 in which charge-sheet has been submitted under Section 85 of the BNS, 2023.

Learned counsel for the petitioners submits that the petitioners are the husband and the mother-in-law of the alleged victim. During pendency of

the proceeding, a compromise and settlement has been arrived at between the private parties of all disputes that had led to registration of the FIR. The parties do not want to proceed with the criminal case. The husband and the wife are presently staying together at the de facto complainant's matrimonial home.

Learned counsel for the de facto complainant supports such contention of the petitioners and submits that in view of such settlement, the impugned criminal proceeding may be quashed.

Learned counsel for the State relies on the case diary and submits that the State would not come in the way of any settlement that may be arrived at between the private parties. Incidentally, there is no injury report present in the case diary.

It appears that a settlement and compromise has been arrived at between the private parties of the disputes that had led to the initiation of the criminal proceeding and the husband and the wife are staying together at present.

Considering the above and in the interest of justice, I hereby quash the impugned proceeding arising out of Bhaktinagar Police Station Case No.812/2025 dated 17.08.2025 on the ground of settlement between the private parties.

Accordingly, CRAN 1 of 2026 is disposed of.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
