Matter relates to transfer of the petitioner on the ground of distance in between the present school of the petitioner and his place of residence. An application for transfer was made on Utsashree portal on August 24, 2022 and same was forwarded by the school authority where petitioner is presently working to the concerned District Inspector of Schools (S.E.) on September 2, 2022 for taking further steps. District Inspector of Schools (S.E.), Cooch Behar on processing the transfer application of the petitioner forwarded the same through portal on September 26, 2022 to the West

Bengal Central School Service Commission for taking final decision.

The grievance of the petitioner is in spite of receipt of transfer application far back on September 20, 2022 the Commission has not decided the transfer application finally.

Respondents are represented by learned advocates who have submitted that due to suspension of portal contemporaneous decision could not be taken on transfer application of the petitioner.

However, it is submitted on behalf of West Bengal Central School Service Commission that if concerned authority is directed decision shall be taken in accordance with law on transfer of the petitioner. Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.3 to decide transfer application of the petitioner by eight (8) weeks from the date of communication of this order and the decision to be communicated to the petitioner by one (1) week thereafter.

It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

Accordingly, WPA 393 of 2025 is disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings.
