(NDPS) 187 of 2023 sl no. 55 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with NJP PS case no. 890 of 2017 dated 31.10.2017 under section 20(b)(ii)(c)/23(c) of the NDPS Act And In Re : Habibul & Anr.

...... petitioners Mr. Debasish Mukhopadhyay ...... for the petitioner Mr. Nilay Chakraborty, Mr. Saikat Chatterjee ...... for the State 34 kilograms of ganja was recovered from a vehicle. Petitioners were present in the vehicle. They had control and dominion over the contraband.

Under such circumstances and in view of the statutory restrictions under section 37 of the NDPS Act we are not inclined to grant bail to the petitioners.

Accordingly, prayer for bail is rejected.
