(NDPS) 188 of 2023 sl no. 56 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Kharibari PS case no. 146 of 2022 dated 6.5.2022 under section 21(c) and 22 (c) of the NDPS Act And In Re : Prasenjit Ghosh ...... petitioner Mr. Satyam Sarkar, Mr. Alok Sah ...... for the petitioner Mr. Nilay Chakraborty, Mr. Saikat Chatterjee ...... for the State 32 bottles of Codeine Phosphate & Chlorpheniramine Meleate Syrup were recovered from the petitioner which is above commercial quantity.

Under such circumstances and in view of the statutory restrictions under section 37 of the NDPS Act we are not inclined to grant bail to the petitioners.

Accordingly, prayer for bail is rejected.
