Mr. Das, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. He has been suffering incarceration since 3rd September, 2024. Upon completion of investigation, chargesheet has already been submitted and as such, further detention of the petitioner may not be necessary and he may be enlarged on bail on any stringent condition.

Drawing our attention to the seizure list, Mr. Acharjee, learned advocate appearing for the State submits that the contraband substance above commercial quantity was recovered from the house of one of the accused persons. In view thereof, the statutory restrictions are clearly attracted.

Heard the learned advocates appearing for the respective parties and considered the materials on record, including the contents of the FIR and the seizure list. Prima facie, the involvement of the petitioner in the alleged offence cannot be ruled out and that as such, rigors of Section 37 of the NDPS Act are attracted.

Accordingly, the application for bail, being CRM (NDPS) 62 of 2025 is dismissed at this stage.
