The primary grievance of the petitioner in this writ petition is that notwithstanding an application being made for an electricity meter as far back as in 2017, the respondent no. 1 to 3 being the West Bengal Electricity Distribution Company Limited has not been able to provide an electricity connection to the petitioner. The petitioner is ready and willing to make payment of all charges for a new electricity connection upon a lawful demand being raised by the respondent authorities.

It is submitted on behalf of the respondent authorities that they have no objection to supply the electricity connection to the petitioner but the private respondent no.4 & 5 who are brothers of the petitioner may resist the respondent authorities. It appears that

there are disputes pending between the petitioner and his brothers.

After considering the facts and circumstances of the case, I direct the respondent authorities to provide an electricity connection as expeditiously as possible preferably within a period of two weeks from the date of making payment by the petitioner.

It is needless to mention that the petitioner will duly pay all the statutory dues and taxes and the usual charges as raised by the respondent authorities. The respondent authorities apprehend that there is a possible law and order problem which may arise in the premises. He submits that the petitioner's brothers may forcefully resist them from installing the electric meter. In case of any resistance being faced by the respondent authorities, a direction is passed upon the Appropriate Police Authorities being the Officer-inCharge, New Jalpaiguri Police Station to provide adequate police assistance to the respondent authorities whilst performing their duties.

Let a copy of this order be served by the petitioner upon the Officer-in-Charge, New Jalpaiguri Police Station for police assistance.

Notwithstanding service being effected, the respondent nos.4 & 5 are not present in Court today. W.P.A.227 of 2019 is disposed off.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, shall be furnished to the parties upon compliance of usual formalities.
