Mr. Debobrata Dhar, AGP, Ms. Paramita Sahu ... for the State The petitioner was engaged as Electrician in the Gurubathan Block Primary Health Centre some times in the year 2008. The petitioner submits that he is working in the said post till date. He further submits that he is getting a very paltry remuneration.

The petitioner prays for regularization of his service.

The petitioner approached the Block Medical Officer of Health of the Gurubathan Block Primary Health Centre for relief.

He prays for a direction upon the Executive Director, Health Department, Department of Home, Health & Family Welfare, Gorkhaland Territorial

Administration to take a decision with regard to his prayer for regularization.

As it appears that the prayer of the petitioner for regularization is pending consideration at the end of the respondents, the writ petition is disposed of by directing the respondent no. 4, being the Executive Director to consider the representation of the petitioner, strictly in accordance with law, within a period of 90 days from the date of communication of a copy of this order after giving an opportunity of hearing to the petitioner and to pass a reasoned order and communicate the same to the petitioner within a fortnight thereafter.

It is made clear that this court has not gone into the merits of the claim of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the prayer of the petitioner. W.P.A. No. 547 of 2020 is disposed of.

Affidavit of service filed in court is taken on record.
