(NDPS) 198 of 2023 sl no. 66 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Jaipaiguri P.S case no.137 of 2021 dated 25.8.2021 under section 21(c) and 22 (c) of the NDPS Act And In Re Binod Ram ...... petitioner Mr. Sri Pinak Pani Banerjee, ...... for the petitioner Ms. Nilay Chakraborty, Mr. Sagnik Sankar Sikdar, ...... for the State 290 bottles of Chlorpherniramine Maleate & Codine Phosphate were recovered from the Motorcycle. Petitioner & coaccused had control and custody of the contraband. Under such circumstances and in view of the statutory restrictions under section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners.

Accordingly, prayer for bail is rejected.
