Mr. Bikash Singha, learned advocate led by Ms. Bedashruti Bose, learned advocate appears for the State. The petitioner was appointed as an Assistant Teacher at the Higher Secondary Level under the Selection Process of 2010.
The petitioner claims transfer from one school to other on the medical ground mentioned in her application for transfer. The application was submitted through online mode as the "Utsashree Portal" stands suspended for the time being.
Mr. Sudip Ghosh Choudhury, learned counsel for the petitioner submits that the necessary application has already been submitted before the School
Authority. The School Authority shall then after obtaining the report from the jurisdictional Block Medical Officer of Health Department upon his satisfaction shall forward the same to the jurisdictional District Inspector of School.
This exercise shall be carried out positively within a period of four weeks from the date of communication of this order.
The jurisdictional District Inspector of Schools then send the report along with the application of the petitioner to the Chief Medical Officer of Health for his opinion and the Chief Medical Officer of Health shall give his opinion immediately positively within a period of two weeks from the date of receiving the record from the District Inspector.
On the basis of such medical report, if the jurisdictional District Inspector is satisfied then he shall transmit the records before the School Service Commission for taking necessary steps in accordance with law.
The District Inspector shall send it to the School Service Commission positively within a period of two weeks from the date of receiving the medical report from the Chief Medical Officer and the appropriate authority of the School Service Commission then shall consider the case of the petitioner positively within a period of
four weeks from the date of receiving the records from the jurisdictional District Inspector.
Since affidavits are not called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.
With the above observations, WPA 404 of 2025 stands disposed of.
