Learned counsel for the petitioner submits that the present application was preferred assailing the order dated 22nd January, 2025 passed by the learned Sessions Judge, Jalpaiguri in Criminal Misc. Petition no. 17 of 2024 cancelling the anticipatory bail granted to the petitioner. During pendency of the present application, the petitioner was arrested and has been released on interim bail. In view of above, the application has become infructuous and is accordingly dismissed.
Learned counsel for the opposite party submits that he has prepared his affidavit in opposition as directed by this Court. The petitioner has obtained the interim bail upon false representation before the learned Magistrate.
The private opposite party has filed an application being CRAN 2 of 2025 in this regard.
Learned counsel for the petitioner disputes the said contention of the opposite party.
The private opposite party is at liberty to take necessary steps in this regard before the appropriate forum.
