1. Heard.

2. Learned Counsel for the State opposes the prayer for bail.

3. The status report as filed today has been perused by us and the same be taken on record. It reveals that sufficient incriminating materials have already been seized and the present accused petitioner has been interrogated for a considerable length of time.

4. Such being the position and keeping in mind that further detention of the present accused petitioner is not necessary, we are inclined to allow the prayer for bail.

5. Accordingly, the petitioner, namely, Kadir Rahaman, shall be released on bail upon furnishing a bond of Rs.10,000/- with two registered sureties of like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Jalpaiguri with a condition that the present accused petitioner shall appear before the learned Trial Court on each and every date of substantive hearing until further orders subject to the condition as mentioned in Section 317 of the Cr.P.C. and shall not leave the district Jalpaiguri unless permitted by the Trial Court. It is further directed that the present accused petitioner shall meet the Enquiry Officer, Malbazar, Ex/Circle twice in a week till submission of the final report.

6. Accordingly, the application for bail is disposed of.
