Mr. Avrojyoti Das Mr. Rajdeep Das Ms. Disha Dey ...for the petitioner This is an application wherein the petitioner has prayed for a direction upon the court below for expeditious disposal of Misc. case being no. 62 of 2022, presently pending before the learned Judicial Magistrate, 4th Court, Siliguri.

It is submitted on behalf of the petitioner that the proceeding was initiated in the year 2023 and it is still pending for payment and adducing evidence. Accordingly, he prays for a direction upon the court below to conclude the entire proceeding within a time frame.

Since the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the application, other parties will have no cause to prejudice, the service of copy of the application or notice upon the opposite parties is dispensed with.

Having considered the statutory direction made under Section 12(5) of the Protection of Women from Domestic Violence Act, I

find that the prayer made by the petitioner is justified and required to be allowed for the ends of justice. In such view of the matter, the revisional application being CRR 87 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the said Misc. case being no. 62 of 2022 and to conclude the entire proceeding preferably within a period of three months from the date of communication of the order.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
