APP Mr. Tapan Bhattacharjee ...for the State This application has been preferred against the order no. 2 dated 9.9.2024 passed by the learned District & Sessions Judge, Darjeeling in Sessions case no. 25 of 2024, wherein the court below has issued warrant of arrest against the petitioners fixing the next date for execution report.

Copy of the present application has already been served upon the State.

It is submitted on behalf of the petitioners that the petitioners were all along diligent in attending the court but since there was a mistake in making entry about next date in the advocate's diary, the learned counsel for the petitioner could not take steps on that particular day and for which, the court below has issued warrant of arrest against all the accused persons. However, the petitioners/accused persons are willing to surrender before the court below and as such, the present application may be disposed of accordingly.

Learned counsel for the State leaves the matter to the discretion of the court.

Having heard the learned counsel for both the parties, the present application being CRR 88 of 2025 is hereby disposed of giving liberty to the petitioners to surrender before the court below within a period of one week from the date of communication of the order and in the event of such surrender before the court below, the Trial Court will dispose of their applications for surrender in accordance with law.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
